HB 837 CPTED ASSESSMENTS

Florida House Bill 837 establishes significant protections against Civil Liability for multi-family property owners that implement specific crime prevention measures (CPTED) and have a documented CPTED Assessment conducted by a law enforcement agency or a Florida Crime Prevention Through Environmental Design Practitioner (FCP Designation).

FSS 768.0706: ‘The owner or principal operator of a multi-family residential property which substantially implements the following security measures on that property has a presumption against liability in connection with criminal acts that occur on the premises which are committed by third parties who are not employees or agents of the owner or operator.’

The Physical Property Requirements in Statute are:

  1. Security camera system at points of entry and exits which records video footage (retrievable for 30 days minimum) to assist in offender identification and apprehension.

  2. A lighted parking lot (average 1.8 foot candles per square foot measured at 18 inches above surface, from dusk to dawn).

  3. Lighting in walkways, laundry rooms, common areas, and porches.

  4. One inch deadbolt (minimum) on each dwelling unit door.

  5. A locking device on each window, each exterior sliding door and any other doors not used for community purposes.

  6. Locked gates with Key or Fob access along pool fence areas.

  7. A peep hole or door viewer on each dwelling unit door that does not include a window or does not have a window next to the door.

    - FSS 768.0706 (2) (b) additionally requires the owner or operator of the multi-family residential property to have a Crime Prevention Through Environmental Design (CPTED) Assessment, that is no more than three (3) years old, completed and documented by a law enforcement agency or a Florida CPTED Practitioner (FCP designation).

    - And, by January 1, 2025 the owner or operator is required to provide proper crime deterrence and safety training to its current employees. After January 1, 2025 the owner or operator must provide such training to all employees within 60 days of hire.
